Uhm Heidi.. explain to me how many MPH above 55mph speed limit you are going if your travelling at 100mph please.

The dirver is at fault. Most drivers take care around cyclists, the same as you do around parked cars with people in them, or roads near schools, or when trying to overtake a parked bus. If you do not pay attention then your going to hit and kill someone. going 45mph ABOVE the speed limit is proof to me that the driver is not only ignorant, but also incredibly stupid and SHOUL be jailed for this. ive seen people go to jail for not paying council tax etc, but your saying its okay to murder someone if theyre not wearing a helmet?

as for your story – if your father was travelling at 65mph he should have slowed down near the cyclist. a speed limit is not telling you “hey this is the speed limit you **Must** go this fast”, its an advisory that you can go that fast if conditions permit. A cyclist on the road does not permit you to rocket past them – they often swirve to avoid potholes which cannot be avoided in bad roads for example.

With your reasoning it would be okay to sue a childs family if they ran out near a school crossing and got hit by a car doing 60 in a 30 zone.. that essentially what your saying.

Too many drivers think they own the road and pay no attention to both cyclists and motorcyclists. the guy should be done for murder, he was using a lethal weapon – the car – and travelling at almost twice the speed limit. if he was over the drink limit heidi i wouldnt be surprised if you didnt say he should have sued the bar for serving him a drink..

dumb people like you make this world a screwed up place. you hate the attitude that the driver is at fault? lets see your kid run down by this driver doing twice the speed limit and see how your attitude changes shall we?

From the philadelphia inquirer – “Enaitz Iriondo, 17, died instantly in August 2004 when businessman Tomas Delgado’s Audi A8 crashed into him at 100 m.p.h. near Haro in northern Spain, an Interior Ministry traffic report said. The speed limit was 55 m.p.h. A regional court found both parties at fault and closed the case, the report said.”

I used to be an avid cyclist. Rode at least 200 miles a week.
Had aspirations of a coast to coast vacation ride…

While I do agree that the majority of bike riders think that we have to completely yield to them. I dont agree with his overall attitude about the situation (in other words…..he’s a dick), he cares more about his car than a person’s life or the pain brought to the family by the abrupt end to it. I personally hope he rots in hell.

well, who says that the driver is completely at fault? i hate the attitude that the car driver is always at fault when someone on a bike gets injured or killed. when i was a child my father was almost killed when someone on a bike went from the shoulder into the middle of the lane on a highway with a 65 mph speedlimit. my father had to slam on his brakes, and a load of lumber in the truck bed flew into the cab, and he narrowly missed being beheaded. the asshole on the bike turned around and continued going down the road and my father jumped out the truck and tackled the guy. my parents took him to court for damages and won. my father was not doing anything wrong, it was the asshole on the bike that caused the accident. this is from the article about this accident you brought up: The youth had been cycling alone at night without reflective clothing or a helmet, according to a police report cited by El Pais.” right there to me is enough evidence that some responsibility might be on the bicyclist. they have to follow the rules of the road too, and can’t just do whatever the hell they please. i’ve had so many near misses with bikes because the person thought they could do whatever they wanted because they were on a bike.
